Berlin Data Protection Commission Reports To Google and Apple To Ban Deepseek From Its Store in Germany

Berlin Data Protection Commissioner reports AI app Deepseek to Apple and Google as illegal and unlawful

Deepseek, a subsidiary of High-flyers, is a Chinese artificial intelligence company founded by Liang Wenfeng in July 2023. It is controlled by Hangzhou Deepseek Artificial Intelligence Basic Technology Research Co., Ltd.


Meike Kamp, Berlin Commissioner of Data Protection and Freedom of Information have reported that Deepseek processes users' personal data, including all text prompt, chat histories and uploaded files and transfers them to Chinese processors and stores it on servers in China.

Meike Kamp described this act to be unlawful as German user's data in China needs to be protected same as the European Union.


As at June 27, 2025, reports have been delivered to the largest app platform, Google and Apple for reviews and decisions to consider a ban on Deepseek in Germany.


OTHER RELEVANT CASES AS AT 2025

In January, the Italian Data Protection Authority, Garante, took an investigation into Deepseek on how it collect, process and store data. 


In February, the Dutch Data Protection Authority took an investigation of Deepseek transferring personal data to China. Aleid Woltsen, the authority's chairman, emphasized the risk associated with personal data stored on Chinese server.


In February, the State Data Protection Inspectorate of Lithuania issues warning still on the case.


In February, the Personal Information Protection Commission (PIPC) of the South Korean temporarily suspended Hangzhou Deepseek Artificial Intelligence Basic Technology Research Co., Ltd., services due to its non-compliance with the Protection Act. The suspension was lifted in April with a condition to report full compliance in 60 days.


In February, the Lower Saxony Data Protection Authority LFD Niedersachson, issued a warning to Deepseek for not complying with the European Artificial Intelligence Act.


In February, the Governor of New York, banned Deepseek from government devices and network 


In February, Taiwan Minister of Digital Affairs prohibited the use of Deepseek by government agencies.


In February, Polish Data Protection Authority issued warning on Deepseek chatbot as users were advised to beware.


In March, Virginia Governor banned Deepseek from government devices and network.

In June, Deepseek was ordered by the Hellenic Data Protection Authority of Greece to appoint an European Union representative which the company complied with
